JUSTICE MOHIT KUMAR SHAH ORAL ORDER 15-06-2017 Heard learned counsel for the petitioner and learned counsel for the State.

This is an application for grant of anticipatory bail in connection with complaint case no. 1918 of 2014 registered for the offences punishable under Section 420 and allied sections of Indian Penal Code.

The allegation against the petitioner is that an agreement for sale of land was executed between complainant and accused persons including the petitioner herein and some amounts were paid to the various accused persons.

Learned counsel for the informant has vehemently

Patna High Court Cr.Misc. No.17157 of 2017 (2) dt.15-06-2017 2/2 opposed the prayer for grant of anticipatory bail. Learned counsel for the petitioner submits that petitioner is innocent, he has not taken any money from the informant, he has clean antecedent and at best, the instant matter can be said to be a matter of civil dispute.

Having regard to the facts and circumstances of the case, I deem it fit and appropriate to enlarge the petitioner on anticipatory bail on furnishing bonds of Rs. 20,000/- (Rs. Twenty thousand) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Katihar in complaint case no. 1918 of 2014 subject to the conditions enumerated under Section 438(2) of Code of Criminal Procedure.
