JUSTICE SAMARENDRA PRATAP SINGH ORAL ORDER 05-07-2016 Heard learned counsel for the petitioner and the State. The petitioner apprehends her arrest in a case under Sections 363 and 366 (A)/34 of the Indian Penal Code. According to the informant, the petitioner's son, namely, Anand Kumar Ram, has kidnapped his grand-daughter in collusion with others.

Learned counsel submits that the petitioner has been falsely implicated in this case, as she happens to be the mother of Anand Kumar Ram. The petitioner submits that she is Head Mistress of Primary School, Lakshmi Sagar, Musahari. She further submits that the victim girl in her statement recorded under Section 164 of Cr.P.C. has not named her as an accused.

No.25715 of 2016 (2) dt.05-07-2016 2/2 In the facts and circumstances of the case, in the event of arrest or surrender before the court below within four weeks from today, the above named petitioner be released on bail on furnishing bail bond of Rs.5000/- (Five thousand) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Madhubani in connection with Madhubani (Town) P.S. Case no. 155 of 2016 (G.R. No. 853 of 2016) subject to the conditions as laid down under Section 438 (2) Cr.P.C. with the further condition that she will not physically absent for two consecutive dates at stretch till one witness is examined.
