Petitioner seeks regular bail in a case registered for the offence punishable under Section 307, 324 and some other ancillary Sections of the Indian Penal Code.
As per the prosecution case, this petitioner is alleged to have cut the neck of husband of informant with the sickle. Learned counsel appearing for the petitioner submits that petitioner is innocent and has falsely been implicated in the case. The informant is not an eye witness of the occurrence. In fact the petitioner and informant are co-villager and neighbour and there is some land dispute between them and for that some altercation has taken place in which the injured, who is aged

Learned counsel appearing for the State and the informant opposed the prayer for bail and submitted that there is specific allegation against this petitioner that he cut the neck of deceased with a sharp cutting weapon and the doctor during medical examination also found corresponding injury on the neck of injured.
Considering the facts of the case and the nature of accusation made against this petitioner, I am not inclined to enlarge the petitioner on bail. Accordingly, the same is rejected. (Prabhat Kumar Singh, J) BKS/- U T
