JUSTICE VINOD KUMAR SINHA ORAL JUDGMENT Date : 24-01-2019 This appeal is for grant of pre-arrest bail to the appellant against the order dated 13.9.2018 passed by Additional District and Sessions JudgeIII, Bhagalpur, in ABP No. 1940 of 2018 by which learned Sessions Judge has rejected prayer for pre-arrest bail of the appellant, who has been made accused in Rail Bhagalpur P.S.Case No. 46 of 2018 registered under Sections 341, 324, 307, 302/34 of the Indian Penal Code, Section 27 of the Arms Act and Section 3(ii)(v) of the Scheduled Castes and Scheduled Tribes (Prevention of Atrocities) Act.
Allegation against the appellant is also of firing and causing injury to mother of informant and later on she succumbed to the injuries and there is allegation of firing against other accused persons to the informant and others.
Submission of learned counsel for the appellant is that the whole case is false and concocted and there is no eye-witness to the occurrence except the informant.

Having heard both sides and in the facts and circumstances, this is not a fit case for grant of anticipatory bail, rather appellant to surrender and make prayer for regular bail, which shall be considered on its own merit, without being prejudiced by this order.
