2. The petitioner is apprehending his arrest in connection with Lakhisarai P.S. Case No. 32 of 2025 for the offence under sections 190, 191(2), 191(3), 115(2), 126(2), 109 and 352 of the B.N.S. and Section 27 of the Arms Act lodged on 27.01.2025 by the informant, Deepak Kumar.
3. As per the prosecution story, the informant alleged that the land which he has taken, some people have come claiming it to be their home. As he reached the place, the allegation is that Raj Kumar opened fire causing injury to the informant while this petitioner opened fire causing injury to Juber Mian. This led to the FIR.
4. Learned counsel for the petitioner tried to impress upon this Court that the allegation in the FIR is wrong, Juber
Patna High Court CR. MISC. No.25203 of 2025(2) dt.07-05-2025 2/2 Mian is not in the list of injured person and the occurrence has taken place due to land dispute between the parties.
5. Learned APP on the other hand opposes the prayer submitting that nowhere in the petition it has been recorded that Juber Mian has not received any injuries and the allegation clearly shows that this petitioner opened fire causing injury to Juber Mian.
6. Considering the direct allegation that has come against the petitioner, no case of anticipatory bail is made out.
