Let the defect(s), if any, be removed within a period of four weeks from today.
The petitioner seeks bail in connection with Dhhibra P.S. Case No. 09 of 2023 registered for the offence under Sections 8(b)/15(b)/18(b)/20(b)/11(c) of the NDPS Act. The allegation against the petitioner is of cultivation of opium in 140 Katha of land.
Learned counsel for the petitioner submits that the petitioner is not the owner of the land in question and nothing has been recovered from the conscious possession of the
Patna High Court CR. MISC. No.24050 of 2023(2) dt.18-05-2023 2/2 petitioner.
Learned counsel for the petitioner also submits that the petitioner is in custody since 08.02.2023. Learned A.P.P. has vehemently opposed the prayer for bail.
Considering the aforesaid facts and the period of custody, this application for regular bail is allowed. Let the petitioner, above named, be released on bail after framing of charge if the charge is not framed yet and on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Special Judge(NDPS)-cum-Additional District and Sessions Judge, Aurangabad in connection with Dhhibra P.S. Case No. 09 of 2023.
