The petitioners apprehend their arrest in connection with Madhepura (Parmanandpur O.P.) P.S. Case No.727/2023, registered for the offence punishable under Sections 147, 148, 149, 341, 342, 323, 324, 325, 307, 186, 188, 332, 333, 393, 504, 506 of the Indian Penal Code.

As per the FIR, when the police reached the place of occurrence for the purpose of checking the illegal manufacturing of wine, the petitioners and others obstructed in their duties and also assaulted them.

It is submitted by learned counsel for the petitioners that petitioners are quite innocent and have committed no offence.

Patna High Court CR. MISC. No. 28975 of 2024(2) dt.03-07-2024 2/2 They have been falsely implicated in this case. No such occurrence, in the manner as alleged, has ever taken place. The allegation levelled against the petitioners is not specific rather general and omnibus in nature. There is no specific overt act against the petitioners and the injuries are of simple nature. Petitioners have no criminal antecedent.

Learned APP for the State opposed the prayer for anticipatory bail.

Considering the nature of offence, I am not inclined to enlarge the petitioners on bail. The prayer for grant of anticipatory bail on their behalf is hereby rejected. 7.

Accordingly, this application is dismissed.
