The petitioner is apprehending arrest in a case registered for the offences punishable under Sections 420, 467, 468, 472, 275 of the Indian Penal Code and 27(b) (ii), 27(d) of the Drugs and Cosmetic Act, 1940.

The prosecution case is that the Drug Inspector, East Champaran inspected the unnamed medicine shop of the petitioner and seized medicines including the expiry medicines having no valid licence.

It is submitted by learned counsel for the petitioner that the premises of nursing home was raided, leading to registration of Chhauradano P.S. Case No.109 of 2015 against

Patna High Court Cr.Misc. No.38888 of 2015 (2) dt.05-10-2015 2/2 the concerned doctor and thereafter maliciously the present case has been lodged against the petitioner. There is nothing on record to suggest that the petitioner was running the medicine shop though the land in question on which the shop is situated belongs to the father of the petitioner. A statement has been made in paragraph 3 of the petition that the petitioner has no criminal antecedent.

The aforesaid facts constitute ground for consideration of prayer for regular bail. Let the learned Court below consider the prayer for regular bail of the petitioner, if the petitioner surrenders within a period of six weeks in connection with Chhauradano P.S. Case No.110 of 2015, pending before the learned SDJM, East Champaran.

With the above observation, this application is, accordingly, disposed off.
