JUSTICE RAKESH KUMAR ORAL ORDER 01-07-2016 Heard Smt. Bela Singh, learned counsel for the petitioners and Sri Dashrath Mehta, learned A.P.P. Two petitioners, apprehending their arrest in connection with Complaint Case No. 2933 of 2013 registered for the offence under section 406, 420, 386, 389, 467, 468, 470, 471, 474, 120(B) of the Indian Penal Code, have prayed for grant of anticipatory bail.

It was submitted by learned counsel for the petitioners that petitioners by an agreement had proposed to sale some land to the complainant however , the agreement had come to an end. Thereafter, petitioners have already refunded rupees one

Patna High Court Cr.Misc. No.26535 of 2016 (2) dt.01-07-2016 2/2 lakh. Subsequently at much belated stage the present complaint was filed. She further submits that earlier there were exchange of legal notices between the parties and with a view to put pressure for extracting some money this complaint has been instituted.

Besides hearing, I have also perused the material available on record. In the facts and circumstances of the case, in the event of arrest or surrender within a period of six weeks from today, let both the petitioners namely Binod Kumar Srivastava @ Binod Shrivastava and Jagannath Prasad @ Jagarnath Pd. be enlarged on bail on furnishing bail bond of Rs. 10000 /- ( rupees ten thousand ) each with two sureties of the like amount each to the satisfaction of learned Sub Judge 8th - cumAdditional Chief Judicial Magistrate , Muzaffarpur/concerned court in connection with Trial No. 489 of 2015 arising out of Complaint Case No. 2933 of 2013 subject to conditions as contemplated under section 438(2) of the Code of Criminal Procedure.
