JUSTICE ARUN KUMAR ORAL ORDER 06-07-2017 Heard learned counsel for the petitioners and the learned APP appearing on behalf of the State. Petitioners apprehend their arrest in connection with Complaint Case No.170(C) of 2017 registered under Sections 419, 420, 467, 468, 471 and 120(B) of the Indian Penal Code. Allegation is that the land belongs to the complainant Mishbaul Hak and these two petitioners sold the same to some other persons by executing sale deeds by committing forgery. Learned counsel for the petitioners submits that it is not the case that these petitioners impersonated the complainant rather claiming the right and title over land executed sale deed in

Patna High Court Cr.Misc. No.30277 of 2017 (2) dt.06-07-2017 2 / 2 favour of purchasers. This complaint was lodged after six years of execution of the sale deed.

Having considered the said facts and circumstances and the fact that dispute appears civil in nature, in the event of arrest/surrender within four weeks from the date of receipt of this order to the concerned court, let the petitioners, named above, be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Seikhpura in connection with Complaint Case No.170(C) of 2017, subject to the conditions as laid down under Section 438(2) Cr.P.C.
