JUSTICE VINOD KUMAR SINHA ORAL ORDER 13-05-2019 This is an application for grant of anticipatory bail in connection with Motipur P.S. Case No.76 of 2019 disclosing offences under Sections 120-B, 353/34 of the Indian Penal Code and Section 30(a), 38(1) (2), 41(1) (2) of Bihar Prohibition and Excise Act, 2018.

As per prosecution story allegation against the petitioner is of recovery of 443.520 liters of foreign liquor from the house of Sunil Kumar Rai and petitioner is said to be the associate of Sunil Kumar Rai.

Submission of the learned counsel for the petitioner is that except the said associate nothing has come against the petitioner. No recovery either from the possession of the petitioner or from his house. Further submission is that petitioner has no criminal antecedent.

Having heard both sides, considering the above submission, this application is allowed. Let the petitioner, above named, in the event of his arrest or surrender before the court below within six weeks, be released on bail on furnishing bail bond of Rs.25,000/- (Rupees Twenty Five Thousand) with two sureties of the like amount to the satisfaction of learned Special Judge, Excise, Muzaffarpur, in connection with Motipur P.S. Case No.76 of 2019 , subject to the condition laid down under Section 438(2) of the Code of Criminal Procedure. (Vinod Kumar Sinha, J) sunil/- U T
