The petitioner is apprehending his arrest in connection with Sadar P.S.Case No. 313 of 2014 registered under Sections 302/34 of the Indian Penal Code.
Learned counsel for the petitioner submits that save and except the allegation the petitioner had at one point of time threatened that the deceased would meet the dire consequence there is no other cogent material so as to implicate the petitioner. Furthermore, another similarly situated co-accused Sanjiv Kumar Das @ Sanjeev Kumar Das, who has been named as one of the four persons, alleged to have given threat to the deceased, has
Patna High Court Cr.Misc. No.28958 of 2015 (3) dt.05-10-2015 been extended the privilege of anticipatory bail in Cr.Misc.No. 26859 of 2015 vide order dated 24.9.2015.
In view of the aforementioned facts and circumstances and also because the petitioner has no criminal antecedent, let the petitioner, above named, in the event of his arrest or surrender in the court below within a period of three weeks from the date of receipt/production of a copy of this order, be released on bail on furnishing bail bond of Rs. 10,000/- (Rupees ten thousand) with two sureties of the like amount each in connection with Sadar P.S.Case No. 313 of 2014 to the satisfaction of the Chief Judicial Magistrate, Darbhanga, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
