Petitioner seeks bail in Barauni (Refinery) P.S. Case No.406 of 2019 registered under Sections 420, 467, 468, 469 and 471 of the IPC.

The informant alleged that he withdrew Rs.3,000/- from his account through ATM on 08.09.2019 but he received a message on the same day that Rs.8,550/- was debited from his account. The informant suspected fraud and accordingly informed the police.

It appears that during course of investigation, the police unearthed a fraud committed by the petitioner and other accused persons for which as many as 19 other criminal cases have been registered. The petitioner and others are used to have cloned the ATM cards of different bank account holders and

Patna High Court CR. MISC. No.21481 of 2020(5) dt.04-11-2020 2/2 fraudulently withdrew a huge amount from their accounts. During course of investigation, the petitioner and others also confessed their guilt.

Having considered the facts aforesaid and the nature of allegations made against the petitioner and the fact that the petitioner has got criminal antecedent and he is accused in as many as 19 other criminal cases, I am not inclined to enlarge the petitioner on bail.
