The petitioner seeks bail in connection with Special Case No.19(A) of 2018, arising out of Bakhtiyarpur P.S. Case No.136 of 2018, registered under Sections 399 and 402 of the Indian Penal Code, Sections 20, 21 and 22 of the N.D.P.S. Act and Sections 25(1-B)a, 26 and 35 of the Arms Act. The accusation is that a Bolero vehicle, which was in high speed, was intercepted by the police from which three persons, namely, Randhir Kumar alias Hadiya, Golu Kumar and Niraj Kumar were apprehended and on search of the Bolero vehicle, 1/2 kilogram Ganja and one pistol were recovered. The aforesaid apprehended persons disclosed the name of the

Learned counsel appearing on behalf of the petitioner submits that the petitioner was not apprehended on the spot and, on mere suspicion, he has falsely been implicated in this case. The petitioner, in the present case, is in custody since 05.11.2018.
Having regard to the facts and the circumstances of the case, the petitioner, above named, is directed to be released on bail on furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the Sessions Judge/Special Judge, Patna, in connection with Special Case No.19(A) of 2018, arising out of Bakhtiyarpur P.S.
