Let the defect(s), if any, be removed within a period of four weeks from today.

The petitioner seeks bail in connection with Gwalpara P.S. Case No. 178 of 2022 registered for the offence under Section 302 of the Indian Penal Code and under Section 27 of the Arms Act.

The prosecution story in short is that the On 16.08.2022 the informant has got information through his wife on mobile that at around 10:00 P.M in the night, his father was shot dead by unknown miscreants. When the wife of the informant got information about the murder from the local villagers then she saw that father was shot in his head in the

Patna High Court CR. MISC. No.24005 of 2023(2) dt.18-05-2023 2/3 house due to which he died. Thereafter they informed the police and police has taken the dead body for post-mortem. Learned counsel for the petitioner submits that the petitioner is in custody since 10.11.2022 and the petitioner is falsely been implicated in this case due to dirty village politics. Learned A.P.P. has vehemently opposed the prayer for bail.

Considering the period of custody, this application for regular bail is allowed.

Let the petitioner, above named, be released on bail after framing of charge if the charge is not framed yet and on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned J.M.F.C., Udakishunganj, Madhepura in connection with Gwalpara P.S. Case No. 178 of 2022.

The petitioner will visit Gwalpara Police Station on the first Sunday of each month. Any default in appearance at the Police Station would result in cancellation of bail bond of the petitioner.
