This application has been filed on behalf of the petitioner for grant of regular bail in connection with Singheshwar P.S. Case No. 20 of 2022 registered for the offence under Sections 393, 326, 307 read with Section 34 of the Indian Penal Code and under Section 27 of Arms Act.

As per the prosecution case, after getting secret information, the informant reached near Doma Chowk, he found that one injured person namely, Gunjan Kumar Sah. On enquiry, he disclosed that some unknown miscreants came and tried to snatch his motorcycle, then victim protested the same and threw the key of motorcycle in bush upon which accused persons fired upon him. Thereafter, raid has been conducted and the accused persons were arrested and one motorcycle was also recovered. Learned counsel for the petitioner submits that no incriminating article has been recovered from the conscious

Learned counsel for the petitioner also submits that the petitioner is in custody since 05.05.2022. Learned A.P.P. has vehemently opposed the prayer for bail.

Considering the fact that similarly situated accused persons have already been granted bail and also considering the period of custody, this application for regular bail is allowed. Let the petitioner, above named, be released on bail after framing of charge if the charge is not framed yet on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Madhepura in connection with Singheshwar P.S. Case No. 20 of 2022.

The petitioner will visit Shankarpur Police Station (Madhepura) on the first Sunday of each month. Any default in appearance at the Police Station would result in cancellation of bail bond of the petitioner.
