JUSTICE ARVIND SRIVASTAVA ORAL ORDER 13-07-2017 Heard learned counsel for the petitioners and the learned A.P.P. for the State.
The petitioners apprehend arrest in connection with Sidhwalia P.S. Case No. 81 of 2014 registered under Sections 363, 363A, 365, 367, 368 of the Indian Penal Code. Learned counsel appearing on behalf of the petitioners submits that as a matter of fact supervising authority has disbelieved the story of kidnapping and has come to the conclusion that at best it is a matter of wage dispute. It is further submitted that similarly situated co-accused has been granted bail by the Court below vide order dated 06.08.2015 passed in A.B.P.
Patna High Court Cr.Misc. No.29235 of 2017 (2) dt.13-07-2017 No. 1235 of 2015. Petitioners have no criminal antecedent. Having considered the facts and circumstances of the case, let the above named petitioners be released on bail, in the event of arrest or surrender before the learned Court below within a period of four weeks from today, on furnishing bail bond of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of Sri R.K. Dwivedi, Judicial Magistrate, 1st Class, Gopalganj in connection with Sidhwalia P.S. Case No. 81 of 2014 subject to the condition as laid down under Section 438(2) of the Cr. P.C.
