Petitioner seeks bail in Tajpur P.S. Case No.294 of 2018 instituted for the offence under Section(s) 272, 273 Indian Penal Code and Section 30(a) of Bihar Prohibition and Excise Act, 2016.

It is alleged that nine litres foreign liquor has been recovered from the maize field adjacent to the boundary of house of O P Sah.

Counsel for the petitioner submits that Petitioner is in custody since 28.09.2018.

In the facts and circumstances of the case, prayer of the petitioner for grant of bail is allowed. Let the petitioner, above named, be released on bail on furnishing bail bonds of

Patna High Court Cr.Misc. No.74522 of 2018(2) dt.13-12-2018 2/2 Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the Additional Sessions Judge 6th cum Special Judge, Excist Act, Samastipur, in connection with Tajpur P.S. Case No.294 of 2018, subject to the condition that both the bailors shall be close relative of the petitioner. It appears that one more case is pending against the petitioner under the Excise Act. The petitioner will file an Affidavit at the time of his release that he will not indulge in such activities in future, otherwise, his bail bond in the instant case will be liable to be cancelled.
