JUSTICE SHIVAJI PANDEY ORAL ORDER 16-12-2015 Heard learned counsel for the petitioner and the State. This Court vide order dated 11.02.2015 had granted provisional bail to the petitioner with respect to Baheri P.S.Case no. 116 of 2014 on an undertaking that he will keep his wife with proper care and dignity and both were physically present on 26.08.2015 and on this undertaking the wife had gone along with her husband.
An affidavit has been filed by the wife where she has stated that the petitioner undertook to take his wife in his native village. The petitioner went at Patna Junction along with opposite party no.2 and they were waiting for train. The family
Patna High Court Cr.Misc. No.37015 of 2014 (6) dt.16-12-2015 2/2 members left her also with the petitioner at Patna Junction. In the meantime, petitioner told opposite party no.2 that he was going out of Railway platform, to take some articles. Thereafter the petitioner did not turn up to carry her to his native village. The manner and conduct of the petitioner compels this Court to withdraw the privilege of provisional bail granted to him vide order dated 11.02.2015 and accordingly this Court withdraws the privilege of provisional bail. He is not remain the beneficiary of provisional bail which has been granted to him in connection with Baheri P.S.Case No. 116 of 2014. The court below (C.J.M., Darbhanga) is directed to take steps and pass necessary orders in accordance with law to ensure the arrest of the petitioner.
The application is disposed of.
