01-07-2016 Heard Sri Mukesh Kumar, learned counsel for the petitioner and Dr. Rabindra Kumar, learned Addl. Public Prosecutor.
The petitioner, who apprehends his arrest in Ganga Bridge P.S. Case No. 37 of 2016 registered for offences under Sections 272 & 273 of the Indian Penal Code and Section 47(A) & 54 of the Bihar Excise (Amendment) Act, 2016, has prayed for grant of anticipatory bail.
Learned counsel for the petitioner submits that up-to 31st March, 2016, the petitioner was dealer and thereafter, he had returned all the materials. However, only on the basis of confessional statement of one of the co-accused, the petitioner has been implicated in the present case.
Patna High Court Cr.Misc. No.26557 of 2016 (2) dt.01-07-2016 2/2 Learned Addl. Public Prosecutor opposing the prayer for anticipatory bail submits that now in view of amendment, the offences alleged has come into serious offences and as such, the petitioner may not be extended the privilege of anticipatory bail. In view of submission made by learned counsel for the petitioner that his name has come on the basis of confession of one of the co-accused, in the event of his arrest or surrender within a period of six weeks from today, let the petitioner namely Subodh Rai @ Subodh Kumar Singh be enlarged on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate/concerned Magistrate, Vaishali at Hajipur in connection with Ganga Bridge P.S. Case No. 37 of 2016 subject to condition as contemplated under Section 438(2) of the Cr.P.C. (Rakesh Kumar, J.) Anay U T
