Let the defect(s), if any, as pointed out by the office, be removed within four weeks.
The petitioner is in custody in connection with Madhepura P.S. Case No. 643 of 2021 under sections 379 and 356 of the Indian Penal Code.
The allegation in the FIR is that when the informant was talking on his phone, the accused persons snatched the same and tried to flee away, but on raising 'hulla' the people gathered there, as a result whereof, the accused persons had to leave their motorcycle and run away. Later the police was able to caught hold of the collar of accused persons, one of them being the petitioner herein.

No.24502 of 2022(2) dt.03-08-2022 2/3 Learned counsel for the petitioner submits that for the said alleged act, he has suffered a lot by being in jail since 30.11.2021(as stated in para-11 of the bail application). He further submits that one of the co-accused namely Vivek Kumar has been granted bail vide Cr. Misc. No. 15584 of 2022 on 16.06.2022. Let the same be kept on record.
Taking into account the nature of allegation made against the petitioner, no recovery has been made from his conscious possession and he is in custody since 30.11.2021, this Court is inclined to grant him the privilege of bail. Let the petitioner be released on bail on furnishing bail bond of Rs. 15,000/- (Fifteen thousand) with two sureties of like amount each to the satisfaction of learned Chief Judicial Magistrate, Madhepura, in connection with Madhepura P.S. Case No. 643 of 2021 subject to the following conditions: (i) one of the bailors should be the family members of the petitioner, who shall provide official document to show his/her bona fide;
(ii) the petitioner shall appear on each and every date before the Trial Court and failure to do so for two consecutive dates without plausible reasons will entail his cancellation of bail by the Trial Court itself;

(iv) the petitioner shall desist from committing any criminal offence again, failing which the State shall be at liberty to take steps for cancellation of his bail bonds. With the aforesaid observations, the bail application is allowed.
