The present modification application has been filed on account of the fact that a mistake has occurred in para 2 of the order dated 23.06.2016. It is submitted by learned counsel for the petitioner, that the error has occurred on account of a bonafide mistake made by the petitioner himself in para 1 of the main petition. It is submitted that in stead of section 304(B)/34, the Section had been noted as Section 304/34 which was a fault on the part of the typist and came to be overlooked. The same was neither deliberate nor intentional.

In view of the submissions made by learned counsel for the petitioner and also for the reasons stated in the present

Patna High Court Cr.Misc. No.27573 of 2016 (2) dt.17-08-2016 2/2 modification application, let the order dated 23.06.2016 be modified in para 2 to be read as Section 304(B)/34 of the Indian Penal Code in stead of Section 304/34 as recorded earlier. With the above modification the application stands disposed of.
