The petitioner apprehends his arrest in a case registered for the offence under Sections 302/34, 120(B) of the Indian Penal Code and Section 27 of the Arms Act. Learned counsel for the petitioner submits that petitioner has committed no offence, as alleged in the F.I.R., and entire F.I.R. is false and concocted. He further submits that it is an error of record that process of Section 82 and 83 of the Cr.P.C. has been issued.
However, in the impugned order, learned Sessions Judge has referred different paragraphs of the case diary and stated that process under Section 82 and 83 of the Cr.P.C. has already been issued against this petitioner.
