====================================================== CORAM: HONOURABLE MR. JUSTICE DR. ANSHUMAN ORAL ORDER 30-04-2025 Heard Learned Counsel for the petitioner and Learned APP for the State.
2. The petitioner is apprehending arrest in connection with Bithan P.S. Case No. 33 of 2023 lodged on 22.03.2023, for the offence punishable under Sections 356, 379, 411 and 34 of the Indian Penal Code.
3. As per the prosecution, FIR has been lodged against unknown accused persons with allegation that the three accused persons came on a motorcycle and snatched two mobile phones along with a purse containing Rs. 4,000/- from the informant.
4. Learned Counsel for the petitioner submits that the F.I.R. has been lodged against unknown persons. The petitioner is innocent and has committed no offence. His name has figured in the case by virtue of the confessional statement of the coaccused and by virtue of said confession, two criminal cases have been lodged by the Police on the same day namely, Bithan
Patna High Court CR. MISC. No.23532 of 2025(2) dt.30-04-2025 2/2 P.S. Case No. 34 of 2023 and the present case, vide Bithan P.S. Case No. 33 of 2023. Learned Counsel for the petitioner specifically submits that it has specifically been mentioned at paragraph-10 of the petition that during course of investigation, one Om Prakash was absconded and disclosed from whose possession a stolen mobile has been recovered but the said Om Prakash did not disclose the name of the petitioner.
5. Learned APP for the State opposes the prayer for bail of the petitioner.
6. As such, in the present facts and circumstances of this case, let the above named petitioner be released on anticipatory bail, in the event of arrest or surrender before the Trial Court within a period of 4 weeks from today, on furnishing bail bond of Rs.30,000/- (Rupees Thirty Thousand) each as mentioned in Section 2(1)(d) of the BNSS, 2023 to the satisfaction of learned Judicial Magistrate-I, Rosera, in connection with Bithan P.S. Case No. 33 of 2023, subject to the conditions as laid down U/s 482(2) of the BNSS, 2023. (Dr. Anshuman, J) Neha/- U T
