ANJANA MISHRA ORAL ORDER 05-10-2015 Heard learned counsel for the petitioners and learned counsel appearing on behalf of the State.
The petitioners being father-in-law and cousin father-inlaw of the deceased are apprehending their arrest in connection with Sahebganj P.S.Case No. 260/14, corresponding to G.R.No. 2538/14, registered under Sections 304B/34 of the Indian Penal Code.
Learned counsel for the petitioners submits that though a case of dowry death has been made out yet subsequently it has been found that the deceased committed suicide. It is further submitted that the husband of the deceased is already in custody. Considering the nature of allegation made and that it has been submitted by father of the girl that the deceased was having
Patna High Court Cr.Misc. No.28966 of 2015 (3) dt.05-10-2015 mental ailment, let the petitioners, above named, in the event of their arrest or surrender in the court below within a period of three weeks from the date of receipt/production of a copy of this order, be released on bail on furnishing bail bonds of Rs. 10,000/- (Rupees ten thousand) each with two sureties of the like amount each in connection with Sahebganj P.S.Case No. 260/14, corresponding to G.R.No. 2538/14 to the satisfaction of SubDivisional Judicial Magistrate, Muzaffarpur, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
