ANJANA MISHRA ORAL ORDER 01-09-2016 Heard learned counsel for the petitioners and the learned counsel appearing on behalf of the State. The petitioner No.2 Tuttu Pandey is apprehending his arrest in connection with Narhat P.S. Case No.94 of 2016 for allegedly having committed the offence under Sections 341, 323, 504, 307, 379 and 506/34 of the Indian Penal Code. It is submitted on behalf of petitioner no.2 that the allegation against him is that he has attacked the informant by hard and blunt substance. It is further submitted that the injuries purported to have been inflicted by the present petitioner have been found to be simple in nature. There is case and counter case between the parties.

However, considering the facts and circumstances, the

No.29072 of 2016 (3) dt.01-09-2016 2/2 nature of the allegations and also that Petitioner No.2 has no criminal antecedents, let Petitioner No.2 Tuttu Pandey, in the event of his arrest or surrender before the court below within a period of four weeks from the date of receipt/production of a copy of this order, be released on bail on furnishing bail bond of `10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial Magistrate III, Nawada, in connection with Narhat P.S.
