Petitioner is in custody in connection with Brahmpur (Chakki) PS Case No. 489 of 2018 for the alleged offence under Section 30(a) of the Bihar Prohibition and Excise Act. Learned counsel representing the petitioner submits that the petitioner is in custody since 01.11.2018 He further submits that the petitioner has no criminal antecedent and has been implicated in the instant case on mere suspicion. He also submits that nothing was recovered from the possession of the petitioner and he has no concern with the alleged recovery of 29.05 liters of whiskey. He has been falsely implicated in the case.

Considering the totality of the facts and circumstances

Patna High Court Cr.Misc. No.79595 of 2018(2) dt.11-01-2019 2/2 of the case, let the petitioner above named, be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the Additional District Judge 2nd-cum-Special Judge, Excise Act, Buxar in connection with Brahmpur (Chakki) PS Case No. 489 of 2018.
