====================================================== CORAM: HONOURABLE MR. JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 27-08-2025 Heard learned counsel for the petitioners and the State.
2. Petitioners apprehend arrest in a case registered for the offence punishable under sections 341, 323, 447, 504, 506, 34 and 307 of the Indian Penal Code.
3. As per the prosecution case, all the FIR named accused persons including these petitioners came to the house of the informant and assaulted him with iron rod and when his brother came in rescue, he was also assaulted by these accused persons by means of iron rod and stick.
4. It is submitted on behalf of the petitioners that
Patna High Court CR. MISC. No.27116 of 2025(5) dt.27-08-2025 2/2 informant and petitioner no.1 are own brothers and they reside in the same ancestral house. On account of land dispute, marpit took place between the parties in which entire family of petitioner no.1 has falsely been implicated. Doctor has found simple injury. Petitioners claim clean antecedent.
5. Learned counsel for the State opposes the prayer for bail.
6. Considering the nature of accusation, prayer for bail of all the petitioners is allowed. In the event of arrest/surrender within eight weeks from today, let these petitioners, mentioned above, be enlarged on bail on furnishing bail bond of Rs.10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of Additional Chief Judicial Magistrate I, Danapur in Bihita Police Station Case No. 254 of 2023, subject to the conditions laid down under section 482 of the Bharatiya Nagarik Suraksha Sanhita, 2023.
