JUSTICE DINESH KUMAR SINGH ORAL ORDER 05-10-2015 Heard learned counsels for the petitioner and the State.

The petitioner is apprehending arrest in a case registered for the offences punishable under Sections 395/412 of the Indian Penal Code.

The prosecution case is that the informant was carrying husk in a pick-up van when five miscreants came surrounded and snatched Rs.2000/- from the pocket of the informant when alarm being raised a police jeep reached there and out of five miscreants three were apprehended whereas two managed to escape from the scene. The apprehended accused persons named the two escaped accused persons as Gautam Kumar and the petitioner. It is further alleged that from the possession of co-accused Bipul Kumar Rs.2000/- was also

Patna High Court Cr.Misc. No.39148 of 2015 (2) dt.05-10-2015 2/2 recovered.

It is submitted by learned counsel for the petitioner that the in fact the Bolero van of the petitioner collided with the pick-up van of the informant and for a petty dispute the accusation has been levelled.

Considering the nature of accusation, this Court is not inclined to grant anticipatory bail to the petitioner. Let the learned Court below consider the prayer for regular bail of the petitioner, if the petitioner surrenders within a period of six weeks in connection with Barbigha P.S. Case No.103 of 2015, pending before the learned CJM, Sheikhpura.

With the above observation, this application is, accordingly, disposed off.
