Learned counsel for the petitioners seeks permission to withdraw the present anticipatory bail application with respect to petitioner No. 1.

Permission is accorded.

The petitioner No. 2 apprehends his arrest in a case registered for the offences punishable under Sections 147, 148, 149, 353, 332, 333, 307, 337 and 338 of the Indian Penal Code. The informant alleges that 200-250 accused persons included the petitioner no. 2 created ruckus and obstructed in discharge of official duty and pelted stones when encroachment

Learned counsel for the petitioner no. 2 submits that petitioner no. 2 is person with clean antecedent and has been falsely implicated in the present case, it is next submitted that allegation of assault is general and omnibus in nature and no specific overt act has been alleged against the petitioner. Learned A.P.P. for the State opposes the prayer for anticipatory bail of the petitioner no. 2.

Considering the submissions made by the learned counsel for the petitioner No. 2, Jitendra Ram, in the event of his arrest or surrender before the learned trial court within a period of six weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned trial court where the case is pending/successor court in connection with Buxar P.S.
