The State of Bihar .... .... Opposite Party/s ====================================================== Appearance :

For the Petitioner/s : Mr. Amresh Kumar Sinha For the Opposite Party/s : Mr. Ajay Kr.Jha, APP ===================================================== CORAM: HONOURABLE THE CHIEF JUSTICE ORAL ORDER 09-07-2015 The petitioner is facing allegation of committing offence under Sections 366/366A/34 of the Indian Penal Code in connection with Rajgir PS Case No.60 of 2014, pending in the court of Sub Divisional Judicial Magistrate, Nalanda. Apprehending his arrest, the petitioner filed ABP No.709 of 2014 in the court of learned Sessions Judge, Nalanda. The same was dismissed on 12.6.2014. Hence, this application. Heard learned counsel for the petitioner and the learned Addl. Public Prosecutor.

The principal ground urged by the petitioner is that though the offence is said to have been committed on 5.1.2014, the complaint was submitted on 18.2.2014. That, however, is a matter which needs to be taken into account at the stage of trial.

Patna High Court Cr.Misc. No.31617 of 2014 (4) dt.09-07-2015 2/2 Having regard to the serious nature of the offence alleged against the petitioner, this Court is not inclined to grant anticipatory bail. This application is accordingly rejected.
