ANJANA MISHRA ORAL ORDER 05-10-2015 Heard learned counsel for the petitioner and learned counsel appearing on behalf of the State.

The petitioner is apprehending his arrest in connection with Sarai P.S.Case No. 125/14 registered under Section 395 of the Indian Penal Code.

Learned counsel for the petitioner submits that though the petitioner is not named in the FIR his name has surfaced subsequently in the confessional statement before the police by some of the persons who were arrested near the truck which had been taken away from the hands of the informant by administering intoxicated drink. Learned counsel further submits that such a statement before the police has no evidentiary value and the petitioner may be extended the privilege of anticipatory bail.

Patna High Court Cr.Misc. No.28940 of 2015 (3) dt.05-10-2015 Considering the aforementioned facts and circumstances and that the petitioner has no criminal antecedent, let the petitioner, above named, in the event of his arrest or surrender in the court below within a period of three weeks from the date of receipt/production of a copy of this order, be released on bail on furnishing bail bond of Rs. 10,000/- (Rupees ten thousand) with two sureties of the like amount each in connection with Sarai P.S.Case No. 125 of 2014, corresponding to G.R.No. 3576/14, to the satisfaction of the Chief Judicial Magistrate, Vaishali at Hazipur, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
