Petitioners were granted privilege of anticipatory bail by learned Sessions Judge, Bhagalpur vide order dated 30-05-2015 passed in A.B.P. No. 847 of 2015 giving liberty to petitioners to surrender before the court below within two weeks in Complaint Case No. 2459 of 2014 but petitioners could not surrender before the court below in time, as they were out of station and did not get any information regarding grant of anticipatory bail. Submission on behalf of petitioners is that now petitioners want to surrender before the court below in the light of order dated 30-05-2015 passed in A.B.P. No. 847 of 2015 but due to condition of surrender before the court below within two weeks

Patna High Court Cr.Misc. No.34759 of 2016 (2) dt.21-12-2016 2/2 from the date of receipt of aforesaid order in the court below, they may be sent to judicial custody and, therefore, it is prayed that time for surrender before the court below should be extended. In view of the aforesaid submission, this quashing petition stands disposed off giving liberty to petitioners to surrender before the court below within four weeks from the date of receipt/production of copy of this order in Complaint Case No. 2459 of 2014 and if, petitioners do so, the concerned court shall proceed in accordance with the order dated 30-05-2015 passed in ABP No. 847 of 2015.
