ANJANA MISHRA ORAL ORDER 15-12-2015 Heard learned counsel for the petitioner and learned counsel for the State.

Opposite party no. 2 is absent today.

On the last occasion, he had prayed for adjournment for the day so as to seek further instructions in the matter but today there is no representation on her behalf.

The petitioner no. 1 being the husband and rest petitioners being in-laws of the informant apprehend their arrest

in connection with Sabour (Goradih) P.S. Case No. 252 of 2014 registered for the offences punishable under Sections 147, 148, 149, 341, 342, 325, 307 of the Indian Penal Code and Section 3⁄4 of the Dowry Prohibition Act.

Learned counsel for the petitioners submits that petitioner no. 1 is ready and willing to keep the opposite party no. 2 with full honour and dignity and that there shall be no recurrence of untoward act. Petitioners undertake that all matrimonial harmony shall be restored in her matrimonial home and they will forget all past differences.

Considering the aforesaid submissions, let the petitioner above named, in the event of his arrest or surrender before the court below within a period of three weeks from the date of receipt/production of a copy of this order, be enlarged on bail on furnishing bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Bhagalpur in connection with Sabour (Goradih) P.S. Case No. 252 of 2014, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.

However, it is made clear that if, at all, there shall be any recurrence of untoward incident, leading to mental or physical torture to the opposite party no. 2, it shall be open for her to move

this Court for modification of the order or approach the Court below for any action in accordance with law including cancellation of the bail.
