The petitioner apprehends his arrest in connection with Pupri Police Station Case No. 242 of 2016 registered under Sections 363, 366(A) of the Indian Penal Code. As per the prosecution case, the F.I.R. named accused persons including the petitioner have kidnapped the minor daughter of the informant while she was on the way to her school.
It has been submitted on behalf of the petitioner that the petitioner is quite innocent and has falsely been implicated in this case at the instance of his enemies. The petitioner happens to be an old person aged about 70 years and is suffering from
Patna High Court Cr.Misc. No.19610 of 2017 (3) dt.15-06-2017 cardiac disease. The victim in the statement recorded under Section 164 Cr.P.C. has not named the petitioner rather she has denied the alleged occurrence. Hence, the petitioner deserves the privilege of anticipatory bail.
Considering the aforesaid facts and circumstances of the case and the nature of allegation as made against the petitioner, the petitioner, above named, in the event of his arrest or surrender before the Court below within four weeks, is directed to be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Sub-Divisional Judicial Magistrate, Pupri at Sitamarhi, in connection with Pupri Police Station Case No. 242 of 2016, subject to the condition laid down under Section 438 (2) of the Code of Criminal Procedure.
