The petitioner is accused in connection with Gopalganj (Town) P.S. Case No. 340 of 2018 registered under section 414 of the I.P.C. and section 25(1-b)A/26 of the Arms Act pending in the Court of C.J.M., Gopalganj. Submission of learned counsel for the petitioner is that petitioner is in custody since 01.07.2018. He is quite innocent and has falsely been implicated in this case. Nothing incriminating has been recovered from his conscious possession. Learned A.P.P. appearing on behalf of the State opposed the prayer of the petitioner with submission that the witnesses have also supported the version of the prosecution.
Patna High Court Cr.Misc. No.78590 of 2018(2) dt.25-01-2019 2/2 Having considered the facts and circumstances of the case and nature of allegation, I am not inclined to allow the prayer of the petitioner for bail. Accordingly, this application is rejected.
However, petitioner may renew his prayer for bail after framing of charge.
