2. The petitioner seeks bail in connection with Sarai Ranjan P.S. Case No. 175 of 2024 dated 14.12.2024 registered for the offences punishable under Sections 310(2) and 317(3) of the B.N.S., 2023.
3. As per the prosecution case, the informant is the driver of the Pick-up vehicle which belongs to 'Ambika Bhawani Traders', Patna, bearing Registration No. BR-01 GN/7374. It is further alleged that on 13.12.2024 at about 6.00 P.M., he proceeded from Patna to Madhepura alongwith Pick-up vehicle on which 130 bundle of pumplets were loaded and as soon as he reached at Dalsingsarai at 10.00 P.M., one Apache

No.24368 of 2025(2) dt.17-04-2025 2/3 Motorcycle and one white coloured Scorpio vehicle stopped the vehicle of the informant and two unknown persons boarded on the Motorcycle, pointed pistol on the informant, assaulted and took his mobile phone and Pick-up vehicle and thereafter fled away towards Dalsingsarai. Anyhow, the informant informed the police station and the owner of the said vehicle.
4. Learned counsel for the petitioner has submitted that the petitioner is innocent and has falsely been implicated in this case. It is submitted that the petitioner is not named in the F.I.R. The petitioner is neither the owner nor the driver of the seized Scorpio vehicle. The said Scorpio vehicle has been recovered from the possession of Raushan Giri and not from the possession of the petitioner. The owner of the said Scorpio vehicle is Sanjay Kumar. No incriminating article has been recovered from his possession. No T.I. Parade was conducted till date. There is no statutory compliance of Section 103(3) of the B.N.S.S., 2023. He has no concern with the alleged offence. The petitioner has five criminal antecedents and in all the cases he is on bail as stated in paragraph no. 3 of the bail petition. He is in custody in this case since15.12.2024.
5. Learned A.P.P. for the State has vehemently opposed the bail petition of the petitioner.

Considering the aforesaid facts and circumstances of the case as well as the period of custody, the petitioner, above named, is directed to be enlarged on bail on furnishing bail bond of Rs. 20,000/- (Rupees Twenty Thousand) with two sureties of the like amount each to the satisfaction of learned J.M.F.C.- cum-Additional Munsif, Samastipur in connection with Sarai Ranjan P.S. Case No. 175 of 2024 with further condition:- (I) The petitioner is directed to remain physically present before the learned court below on each and every date, failing which on two consecutive dates without reasonable cause, the bail bonds of the petitioner are liable to be cancelled.
