JUSTICE DINESH KUMAR SINGH ORAL ORDER 02/ 09-11-2016 The present application has been preferred for modification of order dated 25.05.2016 passed in Cr. Misc. No. 23494 of 2016, whereby the petitioner's anticipatory bail application was disposed of with observation that since accusation is omnibus and general it is a case for consideration of prayer for regular bail by the learned court below in connection with Siwan Muffasil P.S. Case No. 33 of 2016 registered under Sections 147, 148, 149, 323, 307, 504 and 506 of the Indian Penal Code, pending in the court of learned Chief Judicial Magistrate, Siwan. It is submitted by learned counsel for the petitioner that similarly situated accused Dayanand Singh and Sonu Kumar @ Sonu Singh in counter case have been granted anticipatory bail vide order dated 24.05.2016 passed in Cr. Misc.

Patna High Court Cr.Misc. No.33648 of 2016 (2) dt.09-11-2016 2/2 No. 23250 of 2016.

This Court is not inclined to revise the earlier order on merits, but keeping in view of the fact that the two accused of counter case lodged by the petitioner side have been granted anticipatory bail, it is a case for consideration of prayer for bail, if the petitioner surrenders before the learned court below within a period of six weeks from today. It is expected from the learned court below to dispose of the bail application of the petitioner preferably on the same day.

Accordingly, this application is disposed of with the above observation and direction.
