Mr. Nand Kumar ====================================================== CORAM: HONOURABLE MR. JUSTICE MOHIT KUMAR SHAH ORAL ORDER 18-01-2019 Heard the learned counsel for the petitioner and the learned APP for the State.
The petitioner seeks regular bail in connection with Jogbani P.S. Case No. 18 of 2018 for the offences punishable under Section 395 of the Indian Penal Code.
The allegation is regarding unknown miscreants having committed theft and snatched cash and mobile from the informant.
The learned counsel for the petitioner submits that the petitioner has been falsely implicated in the present case on the basis of confessional statement of the co-accused, namely, Md. Aslam, who has already been granted bail by this Court by order dated 26.10.2018 passed in Cr. Misc. No. 58955 of 2018. The petitioner is stated to have been languishing in custody since
Patna High Court Cr.Misc. No.79391 of 2018(2) dt.18-01-2019 2/2 18.06.2018. Lastly, it is submitted that the petitioner is accused in four other cases and he is ready to abide by such conditions as may be imposed by this Court.
Having regard to the facts and circumstances of the case, the petitioner, above named, is directed to be enlarged on regular bail on furnishing bail bonds of Rs. 10,000/- with two sureties of the like amount each to the satisfaction of learned A.C.J.M., 1st, Araria in connection with Jogbani P.S. Case No. 18 of 2018. It is further directed that the petitioner shall mark his attendant before the concerned Police Station on every Monday of the week at 10 A.M. and co-operate in the investigation. His failure to mark attendance before the concerned police station on two consecutive dates would render the present order void.
