JUSTICE VINOD KUMAR SINHA ORAL ORDER 20-06-2019 This is an application for grant of anticipatory bail in connection with Barhara P.S. Case No.302 of 2017, disclosing offences under Sections 8/20 (b)(ii)(c)/22(c) of the N.D.P.S. Act. Allegation of recovery of huge quantity of Ganja from the house of Sunil Kumar Singh and the petitioners were made accused on the confession of Sunil Kumar Singh as the person who has supplied the Ganja to the petitioners. Submission of the learned counsel for the petitioners is that they belong to one family and except the confession there is nothing against them.
Heard learned A.P.P. also, who has opposed the prayer
Patna High Court CR. MISC. No.21120 of 2019(3) dt.20-06-2019 2/2 for bail stating that apart from confession paragraphs 94 & 95 disclosed that the witnesses have also stated that petitioners were also seen carrying the Ganja in the house of Sunil Kumar Singh.
Having heard both sides, in view of the allegation and the quantity of the Ganja recovered, I am not inclined to grant privilege of anticipatory bail to the petitioners. With the aforesaid, this application is dismissed. (Vinod Kumar Sinha, J) Sunil Shukla/- U T
