2. The petitioner has preferred this application for grant of regular bail in connection with Obra P.S. Case No. 476 of 2024, dated 15.11.2024 registered for the offences punishable under Sections 191(2), 190, 329(4), 109(1) and 103(1) of the B.N.S., 2023.

3. As per the prosecution case, when the father-inlaw of informant went to tie his cow, the petitioner along with one Pappu Kumar assaulted him. It is further alleged that all the FIR named accused persons, variously armed, entered the house of the informant and again assaulted her father-in-law and one Raju Kumar (dewar of informant) and Raju Kumar

4. Learned counsel for the petitioner has submitted that the petitioner is innocent and has falsely been implicated in this case. He has further submitted that informant's side and petitioner's side are agnates and there is case and counter case between the parties. There is no specific allegation against the petitioner, rather there is general and omnibus allegation against all the co-accused persons including the petitioner. The similarly situated co-accused persons namely, Ramta Singh and Saurabh Kumar have already been granted bail by a Co-ordinate Bench of this Court vide order dated 07.03.2025 passed in Cr. Misc. No. 11698 of 2025. A compromise has already taken place between the parties (Annexure- P/4). The petitioner has clean antecedent as stated in paragraph no. 3 of the bail petition. The petitioner is in custody since 02.01.2025.

5. Learned A.P.P. for the State has opposed the bail petition of the petitioner.

6. Considering the aforesaid facts and circumstances of the case, petitioner's period of custody as well as the fact that a compromise has taken place between both the parties, the petitioner, above-named, is directed to be enlarged on bail on furnishing bail-bond of Rs. 20,000/- (Rupees Twenty

Patna High Court CR. MISC. No.23056 of 2025(2) dt.29-04-2025 3/3 Thousand Only) with two sureties of the like amount each to the satisfaction of learned Sub-Divisional Judicial Magistrate, Daudnagar, Aurangabad, in connection with Obra P.S. Case No. 476 of 2024, on further condition:

(I) The petitioner is directed to remain physically present before the learned trial Court on each and every date, failing which on two consecutive dates without reasonable cause, the bail bonds of the petitioner are liable to be cancelled.

7. The application stands allowed.
