JUSTICE MADHURESH PRASAD ORAL ORDER 17-08-2019 Heard learned senior counsel for the petitioner as well as learned Addl. Public Prosecutor for the State. Petitioner seeks bail in a case registered under sections 473/489 (A) (B) (C ) (D )/ 420 and 120B of the IPC. Recovery of counterfeit currency and some printing cards were recovered from the possession of the petitioner as per prosecution case.

Having similar/ identical allegation, co-accused Pankaj Kumar has already been granted privilege of bail by a coordinate bench of this court vide order dated 01.05.2019 passed in Cr. Misc. no. 13755/2019.

Senior counsel for the petitioner further submits that petitioner is jail custody since 04.10.2018 and has no criminal antecedent prior to instant case.

Let the petitioner be released on bail on furnishing bail bonds of Rs 10,000/- with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Siwan in Basantpur P.S. Case no. 326/2018 subject to the following conditions.

(1) That one of the bailors will be a close relative of the petitioner who will give an affidavit giving genealogy as to how he is related with the petitioner. The bailor will also undertake to inform the Court if there is any change in the address of the petitioner.

(2) That the petitioner will be well represented on each date and if he fails to do so on two consecutive dates, his bail will be liable to be cancelled.
