The petitioner seeks bail in anticipation of his arrest in connection with Excise Case No. 40 C2 of 2020 instituted of the offence under Sections 30(a), 32, 41, 56 (a) of the Bihar Prohibition and Excise (Amendment) Act, 2018.

Regard being had to the fact that there is recovery of four litres of liquor from the house of the petitioner, I am not inclined to grant anticipatory bail to him. The prayer for anticipatory bail is rejected.

No.26480 of 2020(2) dt.21-10-2020 2/2 However, if the petitioner surrenders before the court below and seeks bail, the court below shall take into account the fact that the petitioner is a person of clean antecedent and shall pass order in accordance with law without being prejudiced by the fact that the present petition has not been entertained.
