2. The petitioner seeks regular bail in connection with Tajpur (Halai O.P) P.S. Case No. 237 of 2021 lodged on 14.06.2021 under Section 302/34 of the Indian Penal Code.

3. As per the prosecution case, F.I.R. has been lodged against four named accused persons including the present petitioner to whom there is an allegation that the petitioner in connivance each other has killed the son of the informant.

4. Learned counsel for the petitioner submits that the petitioner is innocent and has committed no offence. He submits that upon bare perusal of the F.I.R., it become crystal clear that F.I.R. has been filed only and only on suspicion. Case diary has been called for and upon bare reading of the case diary, it is clear that the only material against the present petitioner is that he is in relation with the accused Juhi Kumari and only due to

Counsel further submits that the criminal antecedent of the petitioner is clean and the petitioner is in custody since 19.09.2022. He further submits that charge has already been framed and trial has been commenced. He further submits that two of the accused persons have been granted bail vide order dated 18.07.2022 in Cr. Misc. No. 18188 of 2022 and vide order dated 28.09.2022 in Cr. Misc. No. 60923 of 2021.

5. Learned APP for the State opposes the prayer for bail.

In the present facts and circumstances of this case and the submissions made above, let the petitioner above named by granted bail after framing of charge, if the charge is not framed yet and on furnishing bail bonds of Rs. 30,000/- (Rupees Thirty thousand) with two sureties of the like amount each to the satisfaction of learned Additional District and Sessions Judge- IX, Samastipur in connection with Tajpur (Halai O.P) P.S. Case No. 237 of 2021 subject to the condition laid down under Section 437(3) of the Cr.P.C.
