2. The petitioner is in judicial custody in connection with Shashtri Nagar P.S. Case No. 94 of 2024 for the offence under Sections 457, 380 and 411 of the Indian Penal Code lodged on 03.02.2024 by the informant, Prabhat Kumar.
3. As per the prosecution story, the informant alleged that along with his family member she went to his village to attend shradh function and later the care taker informed about the theft, this led to the F.I.R. in which the care taker were also made accused. Subsequently, during the investigation the in the Rajeev Nagar CCTV footage the Scorpio of the petitioner was detected thereafter, the raid was made in his house and certain recovery of theft articles also took place following which he is under judicial custody.

4. Learned counsel for the petitioner submits that though allegation is there, the trial is not likely to be taken up soon, is in custody since 13.02.2024 and if granted bail, he shall be diligently appearing in trial.
5. Learned APP opposes the prayer for bail submitting that in CCTV footage, he was found alongwith Scorpio and there has been certain recovery.
6. Though allegation is there, recovery has also been made, as alleged, he has remained in custody since 13.02.2024 and an undertaking has been given that he shall be diligently appearing in trial, in that background, this Court is inclined to extend him the privilege of bail with conditions.
7. Let the petitioner be released on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of like amount each to the satisfaction of learned ACJM-IX, Patna in connection with Shashtri Nagar P.S. Case No. 94 of 2024 subject to the following conditions:
(i) one of the bailor should be the family member/relative of the petitioner who shall provide official document to show his/her bona fide;
(ii) the petitioner shall appear on each and every date before the Trial Court and failure to do so for two consecutive

(iii) the petitioner shall appear before the concerned police station every month till the conclusion of trial to mark his attendance;
(iv) the petitioner shall in no way try to induce or promise or threat the witnesses or tamper with the evidences, failing which the State shall be at liberty to take steps for cancellation of the bail bonds;
(v) the petitioner shall desist from committing any criminal offence again, failing which the State shall be at liberty to take steps for cancellation of his bail bonds. (Rajiv Roy, J) Adnan/- U T
