The petitioner is in custody in connection with Nayagaon P.S. Case No. 34 of 2018 for the offence under Sections 467, 468, 471, 472, 419, 420/34 of the Indian Penal Code and Sections 66 (c) (6) of the I.T. Act. Learned counsel for the petitioner submits that the petitioner has got no criminal antecedent and he is in custody since 18.01.2019.

Referring to the prosecution case, he submits that the allegation in the instant case is that the petitioner is involved in alluring the innocent people in obtaining Pin Code of ATM and withdrawing huge amount unauthorizedly. He also submits that nothing was recovered from the possession of the petitioner and

Patna High Court CR. MISC. No.24458 of 2019(2) dt.16-04-2019 2/2 similarly circumstanced other co-accused, namely, Chandra Shekhar Singh, Rakesh Kumar and Sanjiv Paswan, have been granted anticipatory bail by different co-ordinate Benches of this Court.

Considering the aforesaid, the petitioner, named above, is directed to be released on bail on furnishing bail bonds of Rs.10,000/- (Rupees ten thousand) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Beguasarai in connection with Nayagaon P.S. Case No. 34 of 2018.
