Heard learned counsel for the petitioner and learned A.P.P. for the State.

The petitioner seeks regular bail in connection with Sadar P.S. Case No. 625 of 2021 lodged under Sections 392, 395, 412 and 414 of the Indian Penal Code.

As per the prosecution case, there is allegation of robbery/dacoity of certain specified items mentioned in the F.I.R.

Learned counsel for the petitioner submits that the material alleged in the F.I.R. and the material mentioned in the seizure list are at all different. He further submits that the petitioner is a businessman and he used to keep the palm oil for

Patna High Court CR. MISC. No.23456 of 2022(2) dt.03-08-2022 2/2 selling. He further submits that petitioner is in custody since 25.11.2021, charge sheet has already been filed and he has clean antecedent.

Learned counsel for the State opposes the prayer for bail and submits that the theft material has been recovered from the petitioner, therefore, bail should be rejected. In the present facts and circumstances of the case and the submissions made above, I am not inclined to grant bail to the petitioner.

Trial Court shall release the petitioner only after framing of the charge imposing conditions to his satisfaction. Present case is disposed of.
