JUSTICE ANJANI KUMAR SHARAN ORAL ORDER 13-11-2020 Heard learned counsel for the petitioner and learned APP for the State through virtual Court proceedings. The petitioner is apprehending her arrest in a case registered for the offence punishable under Sections 363 & 366 A of the Indian Penal Code.
The Prosecution case, in brief, is that petitioner in association of other co-accused is said to have kidnapped the niece of the informant with an intention to sell out or for the marriage purposes.
Learned counsel for the petitioner submits that no such occurrence as alleged ever took place. The petitioner has been falsely implicated in this case due to dirty village politics. As a matter of fact, the niece of the informant was in courtship with the co-accused Suraj Yadav. The victim girl is major. The
Patna High Court CR. MISC. No.24238 of 2020(3) dt.13-11-2020 2/2 petitioner has no concern with the co-accused Suraj Yadav and she went to meet at the residence of his mother for some other purpose. The allegation levelled against the petitioner is not specific rather general and omnibus in nature. The petitioner has no criminal antecedent.
Learned APP for the State opposes the prayer for bail petition.
In the aforesaid facts and circumstances of the case, let the petitioner, above named, in the event of his arrest or surrender before the court below within a period of six weeks from the date of receipt of the order, be released on anticipatory bail on furnishing bail bonds of Rs. 25,000/- (rupees twenty five thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Gopalganj in connection with Thawe P. S. Case No. 204 of 2019, G.R. No.3727 of 2019, subject to the conditions as laid down under Section 438 (2) of the Code of Criminal Procedure. (Anjani Kumar Sharan, J) amitkumar/- U T
