Although in title cause of this petition, names of three petitioners have been mentioned but in para 1 of the petition, it has specifically been averred that the present petition has been filed only on behalf of the sole petitioner no. 3, namely, Md. Abu Saif. Sole petitioner no. 3, namely, Md. Abu Saif wants extension of time for surrender before the court of ACJM I, Sheikhpura in Complaint case no. 17C/2016 in the light of order dated 9.1.2017 passed in Cr. Misc. no. 55179/2016.

Accordingly, this petition stands disposed of modifying the order dated 9.1.2017 passed in Cr. Misc. no. 55179/2016 to this extent that if petitioner no. 3, namely, Md. Abu Saif surrenders before the court of ACJM I, Sheikhpura/ concerned court in Complaint case no. 17C/2016 without four weeks from today, the concerned court shall proceed in the light of order dated 9.1.2017 passed in Cr. Misc. no. 55179/2016.
