Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State.

The petitioner is languishing in custody for the offences punishable under Sections 409/420 of the Indian Penal Code in connection with Rajaun P.S. Case No. 287 of 2016. The petitioner is Chairman of the PACS.

Allegation is that petitioner had to supply 233.441 MT of rice to the Bihar State Food Cooperation, Banka. However, the petitioner supplied only 81 MT rice and the

Patna High Court CR. MISC. No.21568 of 2020(4) dt.05-10-2020 2/2 remaining rice was misappropriated by the petitioner. The petitioner is not ready to pay back the remaining rice or its cost. The petitioner is in custody since 30.01.2020. Considering the nature of allegation, I am not inclined to enlarge the petitioner on bail. Hence, the prayer for bail is refused.
